At XiDRAFT we respect your need for online privacy. To better protect your privacy, this privacy policy describes how and why we collect, store, process and use your information and especially data which can identify you.

Access to the XiDRAFT Services

Users can access the XiDRAFT Services (as defined in the Terms of Use) through our website www.xidraft.com on devices, through APIs, and through third parties. A device is any computer used to access the XiDRAFT Services, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic device. This privacy policy applies to all information collected or submitted on www.xidraft.com and governs your access of the XiDRAFT Services, regardless of how you access it. As a condition to use of the XiDRAFT Services, you consent to the terms of the privacy policy as it may be updated from time to time.

Information

By using the XiDRAFT Services you consent to the collection, transfer, processing, storage, disclosure and other uses described in this privacy policy. All of the different forms of data, content, and information described below are collectively referred to as "information". Such information is collected from you when you register with us, when you use the XiDRAFT Services or when you contact us and submit comments and/or requests. The information we collect is set out on the web page on which we collect it, such as the account details page.

Personal information

For the creation of a user account we request you to enter your email address and you will be asked to choose a password, which will be used solely for the purpose of providing access to your user account. In the course of using the XiDRAFT Services, we may collect further personal information that can be used to contact or identify you. We use this personal information in order (i) to bill you for the XiDRAFT Services, (ii) to provide and further improve the XiDRAFT Services, (iii) to administer (your use of) the XiDRAFT Services, (iv) to improve our understanding of your needs and interests, (v) to personalize and improve your use and experience of the site, (vi) to inform you regarding updates and new services, releases, upcoming events and changes in this privacy policy and/or the Terms of Use, and (vii) to respond to your requests.

Your account

If you are a registered user, you may review, update, correct or delete the information provided in your account profile by changing your account details. If your personally identifiable information changes, or if you no longer desire to use the XiDRAFT Services, you may update or delete your account details. If changes to your information need to be made, we will take reasonable steps to verify your identity before granting access or making corrections. We will always let you have a copy of personal information we have about you, should you request it. If you no longer wish to receive communications from us, please terminate your account or update your account details.

Your documents and online questionnaires

If you use the XiDRAFT Services as an author, you import and edit documents and build a questionnaire with questions, answers and help texts. In the course of providing the XiDRAFT Services we collect, process and store such content imported and created by you.

Billing information

When you start sharing and/or selling your documents using the XiDRAFT Services, we collect some personal and billing information, such as your name, email address and billing address as well as your PayPal email address. When you purchase a document authored by a user of the XiDRAFT Services, we may also collect billing information, such as your name, email address and billing address.

Contacts

You may also ask us to import your contacts by giving us access to your contact files. As of the date this policy went into effect, it is not possible for you to ask us to import your contacts by giving us access to third party services (for example, your email account) or to use your social networking information, if you give us access to your account on social networks, but we may do so in the future with your consent to improve the XiDRAFT Services.

8.

Document assembly

In the course of the document assembly session (as defined in the Terms of Use) as an end user you complete the online questionnaire and submit data on the basis of which a custom-made document is assembled which can then be downloaded. These data are collected and used solely for the purpose of the assembly of the document. As of the date this policy went into effect, after the document has been downloaded and the document assembly session has been closed, the session can no longer be accessed and the data submitted are not stored by us, but we may introduce this option in the future with your consent to improve the XiDRAFT Services.

Data analysis

We automatically record and collect (ourselves or using third party services) information from your device, its software, and your activity on www.xidraft.com. This may include your device's Internet Protocol ("IP") address, browser type, the web page visited before you came to our website, information you search for on our website, locale preferences, identification numbers associated with your devices, your mobile carrier, date and time stamps associated with transactions, system configuration information and other interactions with the XiDRAFT Services. This information is collected in order to improve the XiDRAFT Services, for analysis purposes and to monitor the use of the XiDRAFT Services, for example (i) in connection with the technical administration, (ii) to increase the XiDRAFT Services' functionality and user-friendliness, (iii) to verify users have the authorization needed to process their requests.

Cookies

We use temporary and permanent cookies to collect information and enhance your experience of the XiDRAFT Services. A cookie is a small data file that we transfer to your device. We may use persistent cookies to save your registration ID and login password for future logins on www.xidraft.com. We may use session ID cookies to enable certain features of the XiDRAFT Services, to better understand how you interact with the XiDRAFT Services and to monitor aggregate usage and web traffic routing on the XiDRAFT Services. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all features of the XiDRAFT Services.

Geo-location information

Some devices allow applications to access real-time location-based information (for example, GPS). The XiDRAFT Services do not collect such information as of the date this policy went into effect, but may do so in the future with your consent to improve the XiDRAFT Services. Some of the information we collect from a device, for example an IP address, can sometimes be used to approximate a device's location.

Storage of information

We will retain your information for as long as your account is active or as needed to provide you services. In addition, we may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request.

Our service providers

We use certain trusted third party companies and individuals to help us provide, analyze, and improve the XiDRAFT Services (such as data storage, maintenance services, database management, web analytics, payment processing, and improvement of the Service's features). These third parties may have access to your information only for purposes of performing these tasks on our behalf and under obligations similar to those in this privacy policy. As of the date this policy went into effect, we use Rackspace's storage service to store your information, PayPal to handle payments on your behalf and Google Analytics for web analytics. Sharing of information

We will only share your personal individual information with outside parties when necessary to perform the services requested by you, to respond to any request or when you have given your prior consent. Return email addresses are used to answer the emails we receive. Such addresses are not used for any other purpose and are not shared with outside parties. We never use or share personal information provided to us in ways unrelated to the ones described above without seeking consent. We may disclose aggregated, or otherwise non-personal information, such as usage statistics of the XiDRAFT Services.

Disclosure of information

In certain circumstances we may need to disclose your information, for example if you breach this privacy policy or if you breach the Terms of Use. We may also access your account or disclose information from your account, if required to do so, or if we believe in good faith belief that disclosure is reasonably necessary, to (a) comply with a law, regulation or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of the XiDRAFT Services or its users; or (d) to protect our or any third party's property rights.

Security measures

We are committed to keep your personal information and data secure. In connection therewith (certain sections of) the site may encrypt data using secure socket layer technology ("SSL"). However, no data transmission over the internet can be totally secure and we cannot ensure or warrant the security of any information which you send to us.

Changes in this privacy policy

We may update this policy from time to time and shall indicate on the website when changes have been made. You are encouraged to review the privacy policy whenever you visit the site to make sure you understand how any personal information you provide will be used.

18.

Business transfers

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction, but we will notify you (for example, via email and/or a prominent notice on our website) of any change in control or use of your information. We will also notify you of choices you may have regarding the information.
